These Terms of Service ("Terms") govern your use of the NexGen Advising website and the college admissions counseling, high school academic planning, and specialized pathways advising services we provide (together, the "Services"). By using our website or engaging our Services, you agree to these Terms.

Description of Services

NexGen Advising provides strategic guidance on college admissions, high school academic planning, and specialized pathways advising, including BS/MD, NCAA recruiting, neurodiverse, and international admissions support. The scope, format, and duration of Services provided to a family are set out separately in the engagement or service agreement entered into at the time of enrollment.

No Guarantee of Outcomes

Ethical college advising does not include guarantees. Admissions decisions are made by third-party institutions based on factors outside our control. We do not guarantee admission, scholarship, or any other outcome. What we commit to is a thoughtful, strategic process, honest and realistic guidance, and diligent execution on our clients' behalf.

Client Responsibilities

Families and students engaging our Services agree to provide timely, accurate information; meet agreed-upon deadlines; and communicate openly so that our guidance can be tailored appropriately. Delays or incomplete information may affect the quality or timeliness of our Services.

Fees & Payment

Current service offerings and pricing are described on our Pricing page and confirmed in each client's individual service agreement. Payment terms, including any deposits, installment schedules, or cancellation terms, are set out in that agreement and govern in the event of any conflict with this page.

Website Use

You agree to use our website only for lawful purposes and not to interfere with its normal operation, attempt to access it using unauthorized means, or copy, reproduce, or redistribute its content without our permission.

Intellectual Property

All content on this website, including text, graphics, logos, and materials we provide during an advising engagement, is the property of NexGen Advising or its licensors and is protected by copyright and other intellectual property laws. It may not be reproduced or distributed without our written consent.

Educational, Not Professional, Advice

Our Services provide educational and strategic guidance. They are not legal, financial, medical, or psychological advice. Families should consult appropriate licensed professionals for matters outside the scope of college admissions and academic planning advising.

Limitation of Liability

To the fullest extent permitted by law, NexGen Advising and its advisors are not liable for indirect, incidental, or consequential damages arising from use of our website or Services, including admissions outcomes, decisions made in reliance on our guidance, or website interruptions. Our total liability for any claim relating to our Services is limited to the fees paid for the Services giving rise to the claim.

Termination

Either party may end an advising engagement in accordance with the terms of the applicable service agreement. We reserve the right to restrict access to our website for any use that violates these Terms.

Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any disputes arising under these Terms will be resolved in the state or federal courts located in Florida.

Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the effective date at the top of this page. Continued use of our website or Services after changes are posted constitutes acceptance of the revised Terms.
